Accommodation Terms and Conditions

●Scope of Application

Article 1
1. The accommodation contract and any related contracts entered into between the hotel and its guests shall be governed by the provisions of these Terms and Conditions. Matters not specified herein shall be governed by applicable laws and regulations or generally established customs.
2. Where the hotel agrees to special terms not contrary to laws, regulations, or customs, such special terms shall prevail over the provisions of the preceding paragraph.    

●Application for Accommodation Contract 

Article 2
1. Persons wishing to apply for a lodging contract at this hotel shall provide the hotel with the following information:
(1) Guest name
(2) Dates of stay and estimated arrival time
(3) Accommodation charges (based on the basic accommodation rates in Appendix 1, in principle)
(4) Other matters deemed necessary by the hotel
2. If a guest requests to extend their stay beyond the dates specified in item (2) of the preceding paragraph during their stay, the hotel shall treat this request as a new application for an accommodation contract at the time it is made.  

●Establishment of Accommodation Contracts, etc.

Article 3
1. The lodging contract shall be deemed concluded when the Hotel accepts the application described in the preceding Article. However, this shall not apply if the Hotel proves that it did not accept the application.
2. When the lodging contract is concluded pursuant to the preceding paragraph, the applicant shall pay the application fee specified by the Hotel, up to the amount of the basic lodging fee for the lodging period, by the date specified by the Hotel.
3. The application fee shall first be applied to the final accommodation charges payable by the guest. Should circumstances arise where the provisions of Article 6 and Article 18 apply, the fee shall be applied in the following order: first as liquidated damages, then as compensation. Any remaining balance shall be refunded at the time of payment of charges pursuant to Article 12.
4. If the application fee specified in Paragraph 2 is not paid by the date designated by the hotel pursuant to the provisions of that paragraph, the lodging contract shall lose its effect. However, this shall only apply if the hotel has notified the guest of the payment deadline for the application fee.

●Special provision waiving the requirement for payment of the application fee

Article 4
1. Notwithstanding the provisions of Paragraph 2 of the preceding Article, the Hotel may agree to a special arrangement whereby payment of the application fee specified in said paragraph is not required after the contract is concluded.
2. If, upon accepting an application for an accommodation contract, the Hotel does not request payment of the application fee specified in Paragraph 2 of the preceding Article, or does not specify a payment date for said application fee, it shall be treated as having agreed to the special arrangement described in the preceding paragraph.     

●Refusal of Accommodation

Article 5
1. The hotel may refuse to enter into an accommodation contract in the following cases:
(1) When the accommodation request does not comply with these terms and conditions.
(2) When there are no available rooms due to full occupancy.
(3) When the person seeking lodging is deemed likely to engage in conduct concerning lodging that violates laws and regulations, public order, or good morals.
(4) When the person seeking lodging is deemed to fall under any of the following circumstances: 
①Organized crime groups as defined in Article 2, Item 2 of the Act on Prevention of Unjust Acts by Organized Crime Group Members (Act No. 77 of 1991), organized crime group members as defined in Article 2, Item 6 of the same Act, quasi-members of organized crime groups, persons associated with organized crime groups, or other antisocial forces designated by Suzuki Sogo Kanri Jimusho Co., Ltd., the operator of this lodging facility (hereinafter referred to as “Antisocial Forces”) ② When the entity is a corporation or other organization controlled in its business activities by a member or associate of antisocial forces.
③ When a corporation has among its officers a person who is a member or associate of antisocial forces.
(5) When a person seeking lodging engages in conduct that causes significant nuisance to other lodgers.
(6) When a person seeking lodging is clearly recognized as suffering from a contagious disease.
(7) When violent demands are made regarding lodging, or when demands exceed a reasonable burden, or when business operations are obstructed through deception or coercion.
(8) When lodging cannot be provided due to natural disasters, facility malfunctions, or other unavoidable reasons.
(9) When other circumstances specified by Niigata Prefecture ordinances apply.

●Guest's Right to Cancel the Contract

Article 6
1. Guests may cancel their lodging contract by notifying the hotel.
2. Should a guest cancel all or part of the lodging contract for reasons attributable to the guest (excluding cases where the hotel specified a payment deadline for the reservation deposit under Article 3, Paragraph 2 and requested payment, and the guest cancels the contract before making such payment), the hotel shall charge a cancellation fee as set forth in Schedule 2. However, this shall only apply if the Hotel has agreed to the special terms under Article 4, Paragraph 1, and the Hotel has notified the guest of the penalty payment procedure applicable upon cancellation when agreeing to those special terms.
3. If a guest fails to arrive by 8:00 PM on the day of arrival (or two hours after the specified arrival time, if one has been provided in advance) without contacting the hotel, the hotel may treat the contract as having been canceled by the guest.  

●The Hotel's Right to Terminate the Contract

Article 7
1. The Hotel may cancel the lodging contract in the following cases:
(1) When a guest is deemed to have committed an act in connection with lodging that violates laws and regulations, public order, or public morals.
(2) When a person seeking lodging is deemed to fall under any of the following circumstances:
① Members or associates of antisocial forces
② Corporations or other organizations controlled by antisocial forces in their business activities
③ Corporations whose officers include members or associates of antisocial forces
(3) When a guest causes significant nuisance or engages in disruptive behavior toward other guests.
(4) When a guest is clearly recognized as suffering from a contagious disease.
(5) When violent demands are made regarding lodging, unreasonable burdens are imposed beyond reasonable limits, or business operations are obstructed through deception or coercion.
(6) When lodging cannot be provided due to reasons attributable to force majeure such as natural disasters.
(7) When circumstances specified by Niigata Prefecture ordinances apply.
(8) When a guest smokes in bed, tampers with firefighting equipment, or otherwise fails to comply with prohibited acts stipulated in the hotel's facility usage rules.
2. When the hotel terminates the lodging contract based on the preceding paragraph, no charges shall be levied for lodging services or other services not yet provided to the guest.  

●Accommodation Registration

Article 8
1. Guests shall register the following information at the hotel front desk on the day of their stay:
(1) Guest's name, age, gender, address, telephone number, and occupation
(2) For foreign nationals, additionally: nationality, passport number, previous lodging location, subsequent lodging location, and a copy of the passport
(3) Departure date and scheduled departure time
(4) Other information deemed necessary by the hotel
2. When a guest intends to pay the fees specified in Article 12 using methods substitutable for currency, such as traveler's checks, lodging vouchers, or credit cards, they must present these at the time of registration as described in the preceding paragraph. 
   

●Guest Room Usage Hours

Article 9
1. Guests may use their hotel rooms from 3:00 PM until 10:00 AM the following day. However, this may differ depending on your accommodation plan, so please confirm. For consecutive stays, guests may use their rooms throughout the day, except on the arrival and departure dates.
2. Notwithstanding the preceding paragraph, the hotel may permit use of guest rooms outside the hours specified therein. In such cases, the following additional charges shall apply: ¥3,500 per room per hour (including service charge and tax).    

●Strict Compliance with Usage Rules

Article 10
1. Guests shall comply with the facility usage rules established and posted by the hotel within the hotel premises.    

●Business Hours

Article 11
1. The main operating hours for the Hotel's facilities are as follows. Detailed operating hours for other facilities are provided in the pamphlets available at the front desk, posted notices, and in-room service directories.
(1) Front Desk Cashier and Other Services: 24 hours
(2) Food and Beverage (Facility) Services:
① Breakfast: 07:30 - 09:30 (and other times) Dining Room or Banquet Hall
② Lunch: 12:00 PM - 2:00 PM, etc.
③ Dinner: 5:30 PM - 9:00 PM, etc. Dining Room or Banquet Hall
④ Other Food & Beverage Services
Garden Lounge: 9:00 AM - 6:00 PM, etc.
Nightclub: 8:00 PM - 12:00 AM, etc.
(3) Ancillary Service Facility Hours
① Reception Desk for Banquets/Weddings, etc. 09:00 - 18:00 Other
② Gift Shop 08:00 - 21:00 Other
2. The facilities and hours listed in the preceding section may be temporarily changed when absolutely necessary. In such cases, information will be provided at the front desk or via notices in guest rooms.

●Payment of Fees

Article 12
1. The breakdown and calculation method of the accommodation charges and other fees payable by the guest shall be as set forth in Schedule 1.
2. Payment of the accommodation charges referred to in the preceding paragraph shall be made at the front desk upon the guest's departure or when requested by the hotel, using currency or methods acceptable to the hotel, such as traveler's checks, accommodation vouchers, credit cards, or other equivalent means.
3. Even if a guest voluntarily chooses not to stay after the hotel has provided a room and made it available for use, the accommodation fee shall be charged.  

●The responsibility of this hotel

Article 13
1. The Hotel shall compensate guests for damages incurred in the performance of the lodging contract and related contracts, or due to the Hotel's failure to perform them. However, this shall not apply if the damages were not attributable to the Hotel.
2. The Hotel maintains lodging liability insurance to address incidents such as fire.    

●Handling When Contracted Rooms Cannot Be Provided

Article 14
1. When the Hotel is unable to provide a guest with the contracted guest room, it shall, with the guest's consent, arrange alternative lodging facilities under conditions as similar as possible to the contracted room.
2. Notwithstanding the preceding paragraph, if the Hotel cannot arrange alternative lodging, it shall pay the guest compensation equivalent to the penalty fee, which shall constitute damages. However, no compensation shall be paid if the inability to provide the room is not attributable to the Hotel.  

●Handling of Deposited Items, etc.

Article 15
1. The Hotel shall compensate for any loss, damage, or other harm incurred to items, cash, or valuables deposited by a guest at the front desk, except in cases of force majeure. However, for cash and valuables, if the Hotel requested the guest to declare their type and value and the guest failed to do so, the Hotel's liability for damages shall be limited to ¥150,000.
2. The hotel shall compensate for any loss, damage, or other harm to items, cash, or valuables brought into the hotel by a guest but not deposited at the front desk, if such loss, damage, or harm results from the hotel's intentional act or negligence. However, for items for which the guest did not previously declare the type and value, the hotel shall compensate for damages up to a maximum of ¥50,000, unless the hotel acted with intent or gross negligence.     

●Storage of guests' luggage or personal belongings

Article 16
1. Should a guest's luggage arrive at the hotel prior to their check-in, the hotel shall store it responsibly only if the hotel has given its prior consent. It shall be delivered to the guest upon check-in at the front desk.
2. Should a guest's luggage or personal belongings be left behind at the hotel after check-out, the hotel shall store them for a certain period and then dispose of them in accordance with applicable laws and regulations。    

●Responsibility for parking

Article 17
1. When guests use the hotel's parking lot, regardless of whether vehicle keys are deposited, the hotel provides the space but assumes no responsibility for managing the vehicles. However, the hotel shall be liable for compensation if damage occurs due to the hotel's intentional act or negligence in managing the parking lot.  

●Guest Responsibility

Article 18
1. Should the Hotel suffer damage due to the intentional or negligent acts of a guest, such guest shall compensate the Hotel for the damage incurred.
